HSE Management

The purpose of these safety and health requirements is to ensure compliance to regulatory requirements and to prevent incidents or events that could result in fatality, injury or illness to personnel and/or damage to environment or property.
Environment (“HSE”) laws and permits pertaining to safety, health, environmental protection and fire protection, which are applicable to the location, where the Construction Works are being carried out. Company Artans shall also comply at all times with the requirements, as set forth by the Clients in its health, safety and environment management system (“HSE MS”), policies, operating standards, job site HSE requirements and any special instructions and all requirements stipulated in the project assigned to Artans. These requirements are intended to supplement any safety and health requirements imposed by law with which the Artans is obliged to comply. Artans shall also adhere to any safety and health procedures as may be imposed by Clients. Company Artans shall be held responsible for ensuring that its Subcontractor fulfil all the health, safety, security and environmental (HSE) requirements outlined herein for the whole duration of their activities for the project.

2.0 HSE Leadership And Commitment
|
|
Company Artans is committed to the protection of the environment, the health, and the safety of personnel working as its employee as well as others, who may be affected either by Construction Work or Construction Activities carrying out by Company Artans. It is required that we also fulfil this commitment and in so doing, provides anything is necessary for the protection of people, property and the environment. Company Artans will, in advance, endeavour to eliminate any hazards that could damage to the environment; any foreseeable hazards, which could result in accidental loss, including personnel injury, fire, security, loss and property damage during the carrying out of the Construction Work.
Company Artans shall be held responsible for ensuring that its SubArtanss fulfil all the health, safety, security and environmental (HSE) requirements outlined in project HSE management plan for the whole duration of their activities for the project.
If any conflict or deviation to the HSE rule, requirement and policy exists, then the more stringent one should be followed or shall be accompanied by the appropriate level of approval. Notwithstanding, where local statutory HSE requirements are more stringent, such local legal requirements should be given priority.

3.0 Artans HSE Objectives
|
|
Pursuant to above, the Artans HSE Objectives are:
- To ensure that HSE goals are the prime consideration in the execution of the Construction Work.
- To achieve a target of zero fatalities and zero injuries.
- To minimise any unplanned impact on the natural environment.
- To continue to review the management of HSE throughout the performance of the Construction Work in order to continuously improve performance.
- All accidents, no matter when or how trivial, shall be reported to the immediate supervisor and Company’s representative.
- All accidents, no matter when or how trivial, shall be reported to the immediate supervisor and Company’s representative.
- Artans's machinery, tools and equipment, facilities and other items associated with or utilized in the Construction Work are safe and/or certified for the intended operation.
- Artans maintains proper and good housekeeping at all time during the course of Construction Work.
Company Artans shall strive for a ‘zero’ injury and incident in Construction Workplace and will set a safety and health goal throughout the performance of the Construction Work.
Company Artans’s HSE philosophy is summarised in the following statement:
`NO HARM to PEOPLE, NO ACCIDENT, NO DAMAGE to the ENVIRONMENT and NO LOSS of CONSTRUCTION’s PROPERTY’
All personnel shall take full responsibility for all HSE related issues for the duration of the Artans’s activities on the job site.

4.0 Artans HSE Policy Statement
|
|
Company Artans has prepared, implemented and maintain a written statement of the Health, Safety, and Environment HSE Policy for the Company and Project awarded or assigned to Artans which both should comply with the Occupational Safety and Health act 1994 in respectively.
The Policy shall describe the Artans's HSE philosophies and objectives for the project and shall contain the following:
- Commitment to HSE;
- Establishment of HSE as a line management responsibility;
- Recognition that all incidents and injuries are preventable;
- Emergency preparedness;
- Providing necessary resources to safeguard HSE;
- Compliance with law and regulatory requirements;
- Ensure security of personnel, equipment & property
Its Artans obligation to communicate the intents and requirements of the Company HSE Policy to its work personnel, Subcontractors’ and Vendor’s work personnel.
Artans’s Project HSE Policy shall include, but is not limited to the following:
- Artans shall ensure that Subcontractors’ Project HSE Policy and Standards are aligned with Artans’s Project HSE Policy and shall be comparable to Client’s Policy.
- Artans’s Project HSE Policy statement for the project shall be dated and signed by the Artans Top Management Level Personnel, and shall be submitted to Client for approval.
- Company Artans shall communicate the intents and requirements of the Project HSE policy to its Job Site Personnel, Subcontractors’ and Vendor’s Job Site Personnel involved in the project.
- Company Artans shall draw to the attention of Client any conflicting requirements within the various Project HSE instructions and procedures with which Artans is obliged to comply, prior commencement of the affected activity part of the Project.

4.1 HSE Health, Safety And Environment Policy
|

- Artans shall consecutively contribute to conservation the global environment.
- Artans shall all times prevent and eliminate the risks of occupation illnesses, injuries, and damage to the environment.
- Atrans requires all its employees and subcontractor to fulfil and adhere this policy at all times.

5.0 Proctection Of Constuction Workers, Public, Assets And Environment
|
|
| Artans shall protect the safety and health of Construction Workers and people living or working near the activity from potential hazards and risks carried out by that activity. Artans, shall take all necessary precautions and mitigation measures to protect the Construction Worker and the public and minimise disturbance and inconvenience to the public resulting from performance of the Construction Works.

|
|
A. Pre-Employment Medical Screening
Company Artans requisites that all its employees and construction workers engaged in the work are declared medically fit for the job and healthy by an Occupational Health Doctor. If an employee who has medical diseases or disabilities which may adversely influence his ability to perform his role in the work, he shall report to the committee before the commencement of the work.
Any of the Artans employees and work personnel having the following illnesses are not permitted working at Construction Job Site:
- A history of fits, blackouts and fainting attacks;
- A history of heart disease or heart disorder;
- Asthma, bronchitis, or shortness of breath on exertion;
- Nervous or mental disorder
- Serious defects in eyesight;
- Any other disease or condition that may affect or endanger the person’s safety and health.

B. Medical Welfare of Personnel
Company Artans shall be responsible for the medical benefits of its own and Subcontractor’s employees. Artans shall make necessary arrangements for medical consultation, treatment or hospitalisation if and when necessary and will arrange suitable insurance coverage for such contingencies.
Artans assured that all local personnel are covered by Social Security Organization (“SOCSO”) and that all foreign personnel are covered by Workman Compensation in accordance with the Employee's Social Security Act 1969 and Workmen's Compensation Act 1952 respectively.

C. Company Artans Simple First Aid/Medical Facility At Workplaces
Company Artans is responsible to provide first aid boxes within its workplaces area and construction area. The first aid boxes shall comply to the requirement of HSE Management and for construction Job Site any other requirement of Client’s medical management and health inspections system.
Company Artans is fully responsible at all times for its own personnel and SubArtans’s personnel and shall ensure that medical facilities operating within its area of responsibility are sufficient to accommodate the needs of the workforce and comply with the regulations. Company Artans is also responsible for the repatriation of its own personnel back to their home, if required by their medical condition, and is fully responsible for the insurances of its own personnel.
Company Artans is also fully responsible to ensure that its own Subcontractor comply with Project’s expectation with regard to medical facilities and insurances of the workforce.
Company Artans is also responsible to ensure that Subcontractor personnel receive appropriate medical care during the entire Subcontract work with Artans.

D. Communicable Diseases and Food/Water Safety
Company Artans shall comply at all times with the requirements with regard to communicable diseases management and food / water safety management.

|
|
E. Hygienic Drinking Water And Sanitary Facilities
Company Artans shall provide wherever necessary, sufficient hygienic drinking fluids and toilet facilities to meet health regulations and all other legislated requirements.
|
|
|
F. Occupational Health And Safety Workplace Responsibilities and Obligations’
The supervisors' level responsibility in occupational health and safety work In practice, the employer enacts their responsibilities and obligations by delegating their authority to the supervisors in the line organization. The supervisors' responsibility in occupational health and safety work is determined by the powers related to their tasks and responsibilities.
Clearly defining the occupational safety responsibilities included within the supervisors' job descriptions and powers helps avoid dangerous situations caused by the ambiguity of the work tasks. Occupational safety responsibilities related to work tasks should be recorded in the occupational safety and health policy.

G. Occupational Safety And Health Responsibility Roles
Senior Management
- Procedures concerning the implementation and development of occupational health and safety and its monitoring

Middle Management
- Preparing instructions
- Purchasing machines, equipment and tools
- Monitoring and supervision of working conditions and the work environment
Work Management
- Monitoring the condition of machines, equipment and tools
- Work guidance
- Monitoring that safe working practices and instructions are complied with
Employee Responsibilities
Employee rights and responsibilities in occupational safety are realized individually and also through representatives in the occupational health and safety cooperation procedure. Employees must follow the employer's instructions and regulations and report any dangerous situations to their supervisors.
An employee has the right to leave off work that causes a serious risk to their life or health. The right to leave off work is based on the Occupational Safety and Health Act. An employee can only leave off work if the risk cannot be avoided by any other immediate measures.

7.0 Artans HSE Communication
|
|
Effective communications are vital to the successful implementation of the Company Artans HSE Management Plan and its Project HSE Plan in respectively. Communications will take many forms but their common objective is to improve understanding of HSE matters. Artans shall propose its overall strategy for communications of all matters relevant to Company and Project HSE Plan both for those involved in the Project and at Job Site as required in Artans HSE Management.
Mechanisms for communication and feedback shall include, as a minimum:
- Suggestion boxes;
- System or procedures for the recording of:
- Concerns/recommendations raised during Company Personnel team talks or Project toolbox;
- Concerns/recommendations raised with Artans’s supervisors at the Job Site.
- Public complaints.
Any advice on HSE issues at Job Site generated by Artans’s personnel shall be tabled at the monthly HSE Committee meeting. The conclusion of these discussions shall be communicated back to the Company Artans who shall, in turn, advise its Subcontractors’ and all personnel working at the Job Site

8.0 Artans Occupational HSE Committee And Meetings
|
|
Artans shall form the Occupational HSE committee for Company complying with the requirements specified under Occupational Safety and Health (Safety and Health Committee) Regulations 1997. The Occupational HSE committee meeting shall be held monthly, however, the frequency may be increased if deemed necessary.
The composition of the Artans Occupational HSE Committee shall be in accordance with LAW and, as minimum, shall include the employer representative (either Project Director or General Manager) as the chairman and Artans’s DOSH Registered Safety and Health Officer, as the secretary with 4 committee members represent the Job Site construction worker and 2 represent Job Site management personnel.
The agenda for the meeting shall include the following items as a minimum:
- Security and environment issues and activities;
- Occupational health and safety work in the workplace;
- Review of previous minutes of meeting;
- Occupational health and safety work key performance indicators;
- Incidents and near misses;
- Lessons learned and action items arising from incident investigation;
- Safety and health audit and inspections findings;
- Safety and health promotion and initiatives;
- Occupational health and safety work concerns and issues;
- Interface issues between Artans’s personnel and Subcontractors personnel;
- Feedback from personnel working at the Job Site.
- Review of current and future construction activities;

9.0 Project HSE Plan And Project Security Plan
|
|
The first step in the planning for HSE program and activities is the preparation by Company Artans of a Project HSE PLAN, which has to be submitted to Client for approval upon project commencement and in any case prior to the commencement of any Artans’s activities on the Job Site. This document will be an ‘umbrella’ document which will need to be supported by other HSE procedures.
Company Artans shall implement and maintain its own HSE procedures, work instructions and guidelines during the construction aspects of the works.
The PROJECT HSE PLAN shall be agreed with client prior to its implementation and shall be subject to periodic audit by client. It needs to refer, as a minimum, but not limited, to the following elements of HSE management:
- Leadership and Commitment;
- Policy and Strategic Objective;
- Organisation, Responsibilities, Resources, Standards and Documents;
- Health Management;
- Environment Management;
- Safety & Transportation Management;
- HSE Risk Management / HSE Risk Reviews;
- HSE Training and Familiarisation;
- Prevailing LAWS and Regulations;
- Planning and Procedure;
- HSE Management of Subcontractors;
- Process Safety, Safe Operations, Asset Integrity;
- Management of Change;
- Competence Assurance;
- Incident Management and Emergency Response;
- Implementation and Monitoring;
- Management Review.
Company Artans shall develop its own PROJECT SECURITY PLAN, which has to be submitted to Client for approval upon after project commencement and in any case prior to the commencement of any activities on the Job Site.
The PROJECT SECURITY PLAN needs to refer, as a minimum, but not limited, to the following elements of security management:
- Leadership and commitment
- Policy and strategic objective;
- Organisation, responsibilities, resources & standards;
- Security management
- Security threat assessment;
- Security awareness and training;
- Communication, incident reporting and investigation;
- Emergency response and evacuation;
- Protection of information and information systems;
- Management review, evaluation, inspection and auditing.

9.1 Project HSE Plan And Project Security Plan
|
Company Artans shall develop, implement and maintain HSSE procedures, work instruction, guidelines & checklists for the Job Site that fully reflect the requirements identified in the project HSE plan and the project security plan.
The HSSE procedures for the Job Site shall contain detailed requirements and arrangement for managing the HSSE performance and reporting of all Job Site activities throughout the different phases of the project.
Company Artans’s HSE procedures, work instructions, guidelines & checklists shall also refer to the HSSE aspects related to all specific Artans activities during the project.
The HSSE procedures for the Job Site shall also address those HSSE issues with regard to any visitors or other personnel, who may be exposed to potential hazards whilst present on the Job Site.
All of the HSSE procedures and work instructions shall be principally be prepared in two languages, English and Bahasa Malaysia, in addition to any other language required to suit the composition of the Artans’s and Subcontractor’s personnel.
Whilst the use of dual-language is permissible for certain work instructions, the instructions and wordings in English shall be present and take precedence where there is conflict within the translation. Client shall have the right to request a copy of such documents from Artans at any time. Artans shall submit the HSSE procedures to Client for review upon commencement of work

9.2 Artan's HSE & Security Organization
|
Artans shall establish an internal management structure for the project and shall identify the positions within this structure and the specific roles and responsibilities of its personnel with regard to management of HSE & security (‘HSSE”) for the project.
Artans’s key personnel approved by Client shall have overall responsibility of HSSE at the Job Site. Artans shall also appoint an HSE Manager who shall be responsible for ensuring that all activities on the Job Site are conducted in a safe and secure manner. HSE Manager shall report directly to Artans’s Construction Manager.
The minimum qualification required for the HSE Manager(s) in the department of safety and health (“DOSH”) safety & health officer (“SHO”) certification and registration, as required under the occupational safety and health (safety and health officer) regulation of 1997 (or equivalent / higher, local or international HSE certification approved by owner) with minimum 10 years of HSE experience in major onshore / Oil & Gas Projects.
Company Artans shall appoint adequate number of HSE Supervisors and HSE Officers, who are responsible for enforcement of the HSE requirements at Job Site. The HSE Supervisors will report to the HSE Manager and the HSE Officers will report to the HSE Supervisors respectively.
The minimum qualification required for the HSE Supervisor(s) in the department of safety and health (“DOSH”) safety & health officer (“SHO”) certification and registration, as required under the occupational safety and health (safety and health officer) regulation of 1997 or an international HSE certification approved by owner with a minimum of 3-5 years of HSE experience in major onshore / Oil & Gas Projects.
The minimum qualification required for of the HSE Officer(s) is national institute of occupation safety and health (“NIOSH”) certificate program for safety & health officer or international HSE certification approved by owner, with a minimum of 1-2 years of HSE experience in major onshore Oil & Gas Projects.
Project Client has the right to interview and approve the HSE Manager(s), HSE Supervisor(s) and HSE Officer(s) allocated for carrying out the specific activities or request allocation of more HSE Manager(s), HSE Supervisor(s) and/or HSE Officers if indeed, required.
A minimum of one, full – time, HSE Officer is typically required per 50 – 100 employees on the worksite, depending on the activities and associated risks, with the above mentioned qualifications.
Company Artans shall ensure that HSE Manager(s) and HSE Supervisors shall be certified and shall have the requisite level(s) of qualification, experience and expertise. Company Artans shall submit to Client for approval, the curriculum vitae of the proposed personnel carrying out the HSE functions.
Artans shall also appoint Security Manager(s) and a team of Security Officers responsible for the Organisation and Management of Security at the Job Site.
Company Artans shall ensure that Security Manager(s) and Security Officer(s) shall have the required experience and caliber and Artans shall submit to Client for approval, the Curriculum Vitae of the proposed personnel carrying out the Security functions.
All HSE & Security personnel shall be clearly identified on the Job Site, by wearing a red helmet or a distinctive vest, which shall be approved by Client.

9.3 Compliance With Legislative And Clients Requirements
|
9.3.1 Compliance with Clients’ HSE Requirements
- Company Artans shall comply with all applicable health, safety, and environmental (HSE) laws and permits including fire and security, which are applicable to the location where the construction works are being carried out.
- Artans shall indemnify Clients against all legal costs, fines and compounds imposed and claims and damages incurred as a result of breach or non-compliance with any relevant laws and permits.
- Artans shall comply at all times with the requirements as set forth by Clients in its health, safety and environment management system (HSE MS), policies, operating standards, job site HSE requirements, any special instructions, and all requirements stipulated in the contract.
- These requirements are intended to supplement any known or ought to be known laws and permits applicable at the location where the construction works are being carried out.
- Artans shall take all necessary HSE control and recovery measures related to or arising out of the performance of the contract in order to protect the construction work, the personnel and property of the Clients, Artans, Subcontractors, all third parties and public from the hazards and risks associated with the planning and execution of construction work.
- Company Artans shall be held responsible for ensuring that Subcontractors and third parties fulfill HSE requirements outlined herein.
Notwithstanding the above, Artans shall perform all obligations stipulated in the contract related to the HSE Requirements, HSE Management Requirements And Environmental Management.

9.3.2 Compliance With Legislative Requirements
Company Artans is fully responsible during execution of the work for compliance with the LAW, including (without limitations):
- Relevant national, Malaysian LAW;
- Relevant Johor’s State Enactment;
- Applicable international laws and regulations;
- National and international Standards or Codes of practices;
- The OWNER’s HSE & Security procedures and guidelines;
- Traffic management technical instructions by Malaysian Public Works Department

9.4 Project HSE Risk Assessment Planning
|
To ensure that contractual activities has consistently covered in the management of HSE risks, with assessed HSE risks are effectively manage during the planning stage and upon execution of the contractual activities so as ensuring the assurances of no harm to people, damage to the property and environment
- Assess the HSE risks to each company new contract, and classify them as low, medium, high or very high risks by following the HSE risk matrix. The HSE management and requirements of each contract shall commensurate with the risk classification.
- Define the contract HSE risks, by assessing the activities in the contract work scopes.
- Determine the need for performance indicators and a contract HSE plan based on the contract HSE risks.
- Define the required risks level of monitoring based on the company capability with classified contract HSE risks
- Determine the incentives and consequence management in contract requirements.
- Have a documented process, including procedures and work instructions, subsequently organise these work items into the contract HSE management system, which demonstrates that the company capably to manage the HSE risks.
- Have a competence assurance process for its personnel and assure they are competent.
- Show that its training program supports the management of HSE risks.
- Have a Fitness to Work program, as required by the OSHA for Fitness to Work, for its personnel as assurance they are Fit to Work.
- Have tools or equipment that are suitable for the job and safe to use.
- Inform company’s Subcontractor and its personnel of the HSE requirements of the contracted work activities.
- Verify that company’s Subcontractor manages the HSE requirements of the contractual scopes, review and adhere the contract HSE plan more realistically.
- Provide induction on the HSE risks of the contracted work activities, the controls to manage those risks and applicable HSE requirements for the company Job Site personnel.

9.5 Monitor And Regularly Assess HSE Performance Of Company
|
- Adjust the level of monitoring to help the Company Artans achieve the HSE performance agreed in the contract.
- Ensure that the Company Artans takes action to improve if it does not meet the HSE performance requirements.
- Apply consequence management to Company Artans that show unacceptable HSE performance.
- Regularly review the management of HSE risks in contracted activities. When necessary, define and document actions for continuous improvement.
- Carry out HSE performance review, compile lessons learned and complete the close-out report after completion of contract.
